Limitations for commercial activities in Online Gaming during alarm status in Spain with a punishment up to a million

Today in Spain, there are 104 118 registered corona cases with 9 387 deaths. In average there are around 8 000 new daily cases and the April 1, was the new Spanish record in the deaths per day reaching 923 souls. In the recent dramatic events Royal Decree-Law approved by the Spanish Government decided to limit any commercial activities connected with online gambling.
Restrictions or limitations include
During the period of validity of the declaration of the state of alarm, gambling operators may not carry out the following actions for the Spanish market:
- Promotional activities aimed at attracting new clients by collecting, among others financial amounts, bonuses, allowances, discounts, gifts of bets or games, freebets, quota or prize multipliers or any other similar mechanism (including those promotions found in the operator homepage)
- Promotional activities / communications for existing clients by collecting financial amounts, bonuses, allowances, discounts, gifts of bets or games, freebets, quota or prize multipliers or any other similar mechanism
- Commercial communications in any of the information society services (including individual communications by mailing, banners in some Websites or in the homepage of the operator, sms or equivalent services and social networks but not limited)
Should any of these obligations in the art. 37 of RDL be breached, that will keep the consideration of serious breach for the purpose of 13/2011 Law, 27th May, Gaming Regulation. A serious breach will be punished with fines from hundred thousand to a million Euros.
